Introduction

Epifany, Inc. (“Epifany”), a North Carolina corporation, knows that you take your privacy seriously. We do, too. We are committed to giving you transparency related to our privacy practices and control over your data in connection with Epifany’s Services (as defined in Epifany’s Terms of Service).

This Privacy Policy covers Epifany’s treatment of personally identifiable information (“Personal Information”) and other data that Epifany gathers when you are utilizing Epifany’s Services and related platforms (i.e., website, mobile application, etc.). Individuals under the age of 18 are not eligible to and may not use our Services; we ask that they do not submit any personal information to us. Epifany does not knowingly collect personal data from Minors or allow them to complete surveys. If it comes to our attention that we have collected personal data from a Minor, we may delete this information without notice. By using Epifany, you agree to the collection and use of your personal information as described in this policy. If we make any significant changes to this policy, we will notify you by posting a notice of such changes on the login page.

We have security measures in place that attempt to protect against the loss, misuse and alteration of your Personal Information that is under our control. We use secure socket layer (SSL) encryption to protect the transmission of the Personal Information you submit. Unfortunately, however, no data transmission over the Internet can be guaranteed 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

What Personal Information Does Epifany Collect?

Information we receive from users, including:

  • Information you give us in any way (such as via email, website, mobile application, etc.), including your name, Facebook information (gender, birthday, city of residence), and Twitter handle.

  • Information we get from your use of the Services, including device-specific information, server log information, location information, unique application numbers, local storage and cookies and anonymous identifiers.

Information we receive from businesses, including:

  • Transactional information – We may retain the details of transactions or payments you make on Epifany. If you do not want us to store your payment source account number you can remove it using the billing preferences feature.

Information we receive from third parties, including:

  • Information from other websites, such as our advertising partners.

How Is My Location Tracked?

To provide the Services, Epifany may collect, store and share precise location data, including the real-time geographic location of your device. Where available, location-based services may use GPS, Bluetooth and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices’ approximate location.

How Is My Information Used?

When you use Epifany, we use this information to manage our Services, to contact users and business owners, to serve social ads, and to otherwise operate our Services.

Epifany will use your information to further our business purposes, such as to perform data analysis, audits, fraud monitoring and prevention, to enhance, improve or modify the Services, to identify usage trends, determine the effectiveness of promotional campaigns and to operate and expand our business activities.

From time to time, Epifany may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Epifany, you may not opt out of receiving these communications.

How Is My Information Collected, Stored And Shared?

Any information Epifany collects, including Personal Information, will be placed and stored on a computer server maintained by Epifany or a third-party host. Such information may be copied and cloned for transfer purposes and to create backup copies. Epifany and any third party will agree to implement technology and security features and strict policy guidelines to safeguard the privacy of your Personal Information from unauthorized access or improper use.

Personal Information about our users is an integral part of our business. We neither rent nor sell your Personal Information to anyone. Epifany, however, may share your Personal Information as described below:

  • When you make a payment, we share information with third parties such as authorize.net and other payment providers and gateways.

  • When we market our Services.

  • When we give each business’s owner our analytics information, which includes when a user makes a purchase, how many purchases a user has made, how many pictures were uploaded to Facebook and Twitter and when, and so on.

  • When we share a user’s personal information, such as email address, with business owners who are part of our program.

  • In the event Epifany is sold or there is otherwise a change of control.

Epifany and any participating business users that you have visited will use your Personal Information to communicate with you by mail, telephone, facsimile, e-mail, mobile alerts and SMS text messaging about Epifany or such business users, including in connection with marketing and promotional efforts and to update you about changes to our Services.

Our platform also lets you share information with others. Epifany may disclose your Personal Information to third parties in order to perform services you request or functions you initiate, such as when you post information and materials on Facebook and Twitter. When you post information in a public forum it becomes public, and it may be indexable by search engines. Epifany may use the username and picture you provide for your profile across the Epifany platform, and such information will be treated just like information you decide to make public.

Epifany also may disclose your personal information to comply with a court order, subpoena, search warrant, or other legal process; to comply with legal, regulatory, or administrative requirements of any governmental authorities; to protect and defend our company, its subsidiaries and affiliates, and their officers, directors, employees, attorneys, agents, contractors, and partners, in connection with any legal action, claim, or dispute; to enforce the Terms of Service; to prevent imminent physical harm; and in the event that we find that your actions on our platform violate any laws, our Terms of Service, or any of our usage guidelines for specific products or services.

How Do Social Networking And Third Party Sites Use My Information?

When you link Epifany to any social networking or third party sites, applications or services, please remember that you are bound by the privacy policy of the social network or third-party site, application or service, and Epifany does not control and is not responsible for the privacy practices of such sites. You should consult the privacy policy of such sites to determine the information practices of those sites.

Log Files; Referrers; Cookies And Web Beacons

Your Epifany account Personal Information is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately, and limiting access to your computer and browser by signing off after you have finished accessing your account.

Epifany endeavors to safeguard user information to ensure that user account information is kept private. However, Epifany cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Our website and/or mobile application may contain links to other sites. Epifany is not responsible for the privacy policies and/or practices on other sites. When linking to another site, you should read the privacy policy stated on that site. This Privacy Policy only governs information related to Epifany’s Services.

When you visit our website or use our mobile application, we automatically log your IP address (the unique address which identifies your computer on the internet) which is automatically recognized by our web server. Your IP address is not personally identifiable, however, in certain circumstances, we may link your IP address to your personally identifiable information. A “referrer” is the information passed along by a web browser that references the website that you linked from to reach our site, and may be automatically collected by our web server. System information we collect includes time and date that you access our site, the type of web browser you are using to access our sites, the operating system/platform you are using, and the CPU speed of the computer you are using. This information is sent automatically by your web browser when you are connected to our website. None of this information is personally identifiable.

We may use cookies and web beacons to collect non-personal information. Cookies are pieces of information that our site transfers to your hard drive to store and sometimes track information about you. Most web browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that. However, you may not be able to take full advantage of our site if you do so. Cookies are specific to the server that created them and cannot be accessed by other servers, which means they cannot be used to track your movements around the web. Although they do identify your computer, cookies do not personally identify you or your password (as applicable). We also may use web beacons to collect non-personal information about your use of our site. Web beacons are tiny graphic images that are placed on a web site or in an e-mail and used to monitor the behavior of the user visiting the web site or sending the e-mail. The information collected by web beacons allows us to statistically monitor (i) how many people are using our site, (ii) how many people open our e-mails, and (iii) for what purposes these actions are being taken. Our web beacons are not used to track your activity outside of our site. Since web beacons are used in combination with cookies, if you disable cookies, the web beacons will only detect an anonymous website visit.

Epifany may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes in the way we use Personal Information, we will notify you by posting an announcement or sending you an email. Users are bound by any changes to the Privacy Policy after such changes have been first posted.
